KARA disclaims all liability and is not responsible for damages of any kind, sustained by its users and arising from using the information provided by KARA.

Please read this document carefully. By accessing the website at the addresses http://www.karajewelry.ro, and http://karajewelry.ro respectively, further named "KARA", or by accessing any other way the content of the website you are bound to observe the terms of the document hereinafter on which you express your agreement. In case you disagree with the terms of the present document, please leave KARA and do not access the site on further occasion. Any further access to KARA will be considered an agreement on the terms and conditions presented in the document below.

The terms of the present document entered into force on the 1st of October, 2016.
 

1. Copyright protection

KARA content and design as well as any other material related to KARA and sent to you by e-mail or provided to you in any other way (e.g.: articles, design, and any other materials that will be hereinafter named " KARA Content"), are the property of KARA and its collaborators – where explicitly specified - (copyright) and are protected by the copyright legislation. You may not use, reproduce or allow anyone to use or to reproduce the KARA materials without the written permission of KARA.
Furthermore, you agree that by writing a material (comment, as well as any other type of published message) in KARA, you transfer to KARA an non-exclusive copyright regarding the publishing, republishing, distribution as well as any other form of public display of the above-mentioned material in KARA and KARA products, during the entire time length of the copyright for the above-mentioned materials.

 

2. Use of KARA Content

You may copy and print KARA Content for your personal use only, without intention to sell. As an exception to the above statement, the KARA Content may not be reproduced, modified, and exploited, regardless of the commercial or non-commercial purpose of this use.

The hereinafter described actions are not allowed unless obtaining the previous written permission from KARA:

  • KARA Content reproduction or storage, as well as sending the aforementioned content to any other server, website or other information storage device or media.
  • modification, publishing, transfer, as well as participation to transfer, sale, distribution of materials obtained by reproducing, modifying or displaying KARA Content, without obtaining prior written consent from KARA.
  • Removal of identification marks indicating KARA copyrights on KARA Content.

Any use of KARA Content in purposes, others then those explicitly permitted by the present document, is forbidden. The requests for permission to use KARA Content in other purposes then those explicitly permitted by the present document may be e-mailed to: office@karajewelry.ro.

 

3. Temporary access restriction

KARA may, without further notice or formality, and without this fact requiring explanations of its action, temporally or permanently restrict your access to KARA Content or part of it.

 

4. Website modifications

KARA reserves the right to suspend, modify, add or remove at any moment portions of its Content. Furthermore, KARA reserves the right to restrict the access of the users to its entire Content or to a part of it.

 

5. Confidentiality Agreement

The information you provide to KARA about yourself will be used exclusively according to the terms of the KARA Confidentiality Policy.

 

6. Communication platforms made available by KARA

KARA offers you the possibility to send comments to our articles, as well as to send messages not intended to the public (through our Contact form).

Regarding the comments to our articles, we reserve the right (that can be exercised at the time of our choice and without previous notification), to erase, move or edit these comments.

You are entirely responsible for the content of your messages. For this, you are advised that the message posting or sending on the communication platforms made available by KARA is submitted to the following limitations:

  • You may not publish, send or refer to any kind of message unanimously acknowledged by the society as “advertising” for various categories of goods and services.
  • You may not publish, send or refer to KARA users or members any kind of unrequested commercial message, regardless of the action being performed or not through the communication systems made available by KARA or other means of communication.
  • You may not publish, send or refer in any way to messages containing recommendations to buy or not to buy a certain product or service. As well, you may not publish or refer in any way to messages containing confidential information, regardless of this information being explicitly designated as "confidential" or otherwise indicated as such, or to messages intended to affect the price, the image or the market value of a product or service.
  • You may not publish, send or refer in any way to messages containing illegal, menacing, abusive, indecent texts trespassing in any way any copyrights or other rights held by a third party.
  • You may not publish, send or refer in any way to messages containing viruses or any other code sequences proven to be destructive or that may disrupt, eliminate or limit the functionality of KARA or of any information systems (hardware or software).
  • You may not collect by any mean or method person identifiable information from KARA users or members.
  • You may not restrict or eliminate access of any other users to the communication platforms made available by KARA.
  • You may not publish, send or refer in any way to hidden source messages. 

By conveying your messages to or by any BANU communication media, you agree that you are entirely responsible for and will indemnify KARA for any damage, costs or limitations on profits arising from the posting, transmission or reference by you of messages whose content violates limitations listed in the previous paragraph

 

7. Warning !

KARA is not responsible under any circumstances, for any damage caused directly or indirectly, for any direct or indirect lack of profit (including but not limited to: damages for loss of profit, business interruption, or other pecuniary damages) sustained following the use or interruption of use or any lack regularity in the provision of information or site provided services, in spite of KARA’s previous warning as to the use of this information without a specialist consultant that may generate such damage.

At KARA’s request, you agree to exonerate KARA of the responsibility in any legal or extrajudiciary actions and to cover the court expenses or any other expenses that may arise following your violation of the present Contract.

 

8. Force Majeure 

KARA, its affiliates ad generally the information suppliers to KARA cannot be held responsible for any delay or error in the content supplied by the KARA publications, that may be generated directly or indirectly by causes not depending on KARA’s will. This exoneration includes but is not limited to: functioning errors of KARA’s technical equipment, Internet connection malfunction, telephone connections malfunctions, malware, unauthorized access to KARA servers, operational errors, strike, etc.

 

9. Miscellanea

The change of terms in the present Agreement. KARA is entitled to change the terms of the present agreement, without prior notification or the accomplishment of any other formalities. Nevertheless, after the modification of these terms, KARA will publish on the first page of its website a notification on the subject. Accessing the site and using the KARA services after the publication of the notification implies that you agreed the new terms of the present Agreement.
Notifications. Any notification to KARA will be sent by writing, by mail, at the address mentioned in the present document.

 

10. Law governing the Agreement

The parties’ rights and obligations such as set by the present Agreement, as well as the legal effects produced by the present Agreement will be interpreted and governed according to the Romanian law in force. Any disagreement regarding the object of the present Agreement will be settle in a Romanian court of law..
